The Gentle Sleep Specialist

1. General Information

These Terms & Conditions apply to all services provided by The Gentle Sleep Specialist ("TGSS"), including but not limited to consultations, in-home consultations, one-off calls, online programs, memberships, webinars, workshops, AI support, digital resources, blogs, social media content, written correspondence, email support and any educational information provided verbally or in writing ("Services").

The information provided by TGSS is educational in nature and is intended to support families experiencing common childhood sleep and behavioural challenges. It is not medical advice and should never replace advice, diagnosis or treatment from a qualified medical practitioner or other healthcare professional.

Parents and caregivers should always seek medical advice where there are concerns regarding their child's health, development, feeding, breathing, growth, behaviour or sleep.

By accessing or purchasing any Services, you agree to these Terms & Conditions.


2. Parent Responsibility

Parents and caregivers remain solely responsible for all decisions regarding the care, supervision, health, wellbeing and safety of their child. All recommendations provided by TGSS, team, contractors are educational suggestions only. You are responsible for determining whether any recommendation is appropriate for your child, your family and your individual circumstances.

Participation in any Service is entirely voluntary, and you may discontinue any recommendation at any time. You should attend to your child anytime you are concerned.


3. Medical Conditions

Our Services are designed to assist with common sleep and behavioural concerns that are not caused by underlying medical conditions.

You agree to disclose any known medical, developmental or behavioural conditions that may impact your child's sleep or wellbeing.

These may include, but are not limited to:

  • reflux
  • allergies
  • asthma
  • feeding difficulties
  • respiratory conditions
  • neurological conditions
  • developmental concerns
  • medications
  • seizures
  • recent illness or surgery

TGSS does not diagnose medical conditions. If there is any concern that your child's sleep may have a medical cause, you should seek medical assessment before implementing any recommendations.


4. Safe Sleep & Safe Environment

Parents and caregivers are solely responsible for maintaining a safe sleep and home environment.

TGSS expects families to follow current Red Nose Australia Safe Sleep Guidelines and all applicable child safety recommendations.

This includes, but is not limited to:

  • maintaining a safe cot or bed
  • following age-appropriate sleep recommendations
  • securing furniture and televisions to walls
  • removing choking hazards and small objects
  • securing blind cords and electrical hazards
  • ensuring windows, stairs and rooms are safe
  • appropriately supervising children at all times

TGSS does not inspect your home and cannot verify the safety of your child's environment.if you’re ever concerned about your child’s well-being stepping immediately.


5. Results

Every child and family is different.

While many families experience significant improvements, no guarantee is made regarding sleep outcomes, timelines or specific results.

Sleep can be influenced by numerous factors including illness, developmental changes, temperament, travel, family circumstances, feeding, medications and consistency in implementing recommendations.


6. Educational Information

Information provided through consultations, one-off calls, memberships, online programs, AI support, webinars, blogs, downloadable resources, emails, social media, podcasts, videos, comments, live sessions or any other platform is educational only.

General information should not be interpreted as personalised advice unless specifically provided during an individual consultation.


7. Payment & Refunds

Payment must be received before Services commence unless otherwise agreed.

Consultation cancellations made within 24 hours of the scheduled appointment may incur a late cancellation fee.

Refunds for consultation packages remain subject to the refund policy applicable to the purchased Service. Once initial consult and plan has been sent 20% refund is only applicatble. Digital products, memberships and online programs are generally non-refundable once access has been granted unless otherwise required under Australian Consumer Law.

Memberships may be cancelled in accordance with the membership terms applicable at the time of purchase.


8. Communication

Where follow-up support forms part of a purchased Service, TGSS will make reasonable attempts to provide the agreed support.

If a client is unavailable, does not respond or chooses not to engage, unused support will generally not be replaced or refunded.

Communication methods may include phone, video conferencing, email, SMS or other agreed platforms as stated in plan.


9. Respectful Conduct

TGSS reserves the right to suspend or terminate Services without refund where a client becomes abusive, threatening, harassing or behaves in a manner that places staff, contractors or others at risk.

TGSS also reserves the right to cease Services where there are reasonable concerns regarding the safety or welfare of a child or where recommendations cannot be provided safely.


10. Mandatory Reporting

TGSS complies with all applicable mandatory reporting obligations.

Where legally required, concerns regarding the safety or welfare of a child may be reported to the appropriate authorities.


11. Intellectual Property

All materials supplied by TGSS remain the intellectual property of The Gentle Sleep Specialist.

This includes, but is not limited to:

  • sleep plans
  • videos
  • online programs
  • membership content
  • webinars
  • AI tools
  • downloads
  • checklists
  • worksheets
  • graphics
  • guides
  • written resources

These materials are licensed for personal use only and must not be copied, reproduced, distributed, shared, recorded, resold or used for commercial purposes without prior written permission.




13. Limitation of Liability

To the maximum extent permitted by law, TGSS makes no guarantees or warranties regarding the Services or the outcomes achieved.

TGSS will not be liable for any direct or indirect loss, injury, illness, damage, expense or liability arising from reliance upon, or implementation of, any recommendation provided through the Services.

Nothing within these Terms excludes any rights or guarantees that cannot be excluded under the Australian Consumer Law. Where liability cannot legally be excluded, TGSS's liability is limited, to the extent permitted by law, to the resupply of the relevant Service or the refund of the amount paid for that Service.


14. Definitions

The Gentle Sleep Specialist (TGSS) means Tara Emma Mitchell and any employee, contractor or authorised representative providing Services on behalf of The Gentle Sleep Specialist.

Client means any individual who purchases, accesses or receives any Service from TGSS.

Services means all consultations, one-off calls, in-home consultations, memberships, online programs, webinars, workshops, AI support, blogs, social media content, downloadable resources, digital products, written correspondence, educational materials and any other information or service provided by TGSS.
